These Terms of Use govern access to and use of the SafetyDataSheetAPI website, sample upload endpoint, and related resources. SafetyDataSheetAPI is a product of Dscvry and is operated by Discovery AI Limited, 167-169 Great Portland Street, London W1W 5PF, United Kingdom. By accessing or using the service, you agree to these Terms.

1. Service Scope

The website and sample endpoints are provided for evaluation, integration planning, and commercial onboarding discussions. Production use is governed by separate commercial agreements and service-specific terms.

2. Eligibility and Authority

You represent that you are authorized to act on behalf of your organization and to submit documents and data to the service.

3. Acceptable Use

You are responsible for complying with applicable laws and regulations, including data protection, sanctions/export controls, and industry-specific chemical compliance obligations.

You agree not to:

• Use the service in violation of applicable laws, sanctions, or export-control requirements.
• Upload unlawful, malicious, infringing, or unauthorized content.
• Attempt to bypass rate limits, anti-abuse controls, or security mechanisms.
• Reverse engineer, probe, or disrupt infrastructure and availability controls.
• Use automated systems to generate abusive traffic against sample endpoints.

4. Data Responsibility

You are responsible for ensuring you have rights and permissions to submit files and related metadata. You are responsible for verifying extracted output before operational or regulatory use.

5. Intellectual Property

The service, website content, brand assets, and software components are owned by Dscvry and its licensors, except for customer-provided data. No implied license is granted beyond necessary use under these Terms.

6. Evaluation Environment

Sample upload functionality is rate-limited and protected by anti-abuse controls. We may suspend or block access for abusive, suspicious, or non-compliant activity.

7. Disclaimers

Unless otherwise agreed in writing, the website and sample services are provided on an “as is” and “as available” basis, without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

8. Limitation of Liability

To the maximum extent permitted by law, Dscvry and affiliates are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, data, goodwill, or business interruption arising from service use.

9. Indemnity

You agree to indemnify and hold harmless Dscvry from claims, liabilities, damages, and expenses arising from your misuse of the service or breach of these Terms.

10. Credits, Payments and Taxes

Paid use of the API runs on prepaid credit bought in the dashboard. Payments are processed by Stripe; we do not see or store card details. Prices exclude taxes. VAT or other taxes are added at checkout where they apply, and you receive an invoice for each payment. Credit is for your own use, cannot be transferred or exchanged for money, and expires 12 months after purchase unless a different term is stated at checkout or in a written agreement. Unused credit that has expired is removed from your balance. Documents are charged when an extraction succeeds; a failed extraction is not charged. Prices and pack sizes may change; a change applies to purchases made after it is published. 11. Suspension and Termination

We may suspend or terminate access at any time to protect service integrity, security, legal compliance, or business operations.

12. Governing Law, Terms and Updates

These Terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without affecting any mandatory consumer rights you have in the country where you live.

We may modify these Terms to reflect legal, regulatory, or operational changes. Updates become effective on publication unless otherwise specified.
